Terms & Conditions
This is a legal agreement between the person or organization (“Customer” or “you”) agreeing to these Terms of Service (“Terms”) and the applicable contracting entities at Terms & Conditions (“SaveBox,” “us,” or “we”). By accepting these Terms, placing an Order, or using the Services, you represent that you are of legal age and have the authority to bind the Customer to these Terms, available at Terms & Conditions. (collectively the “Agreement”)
1. Prohibited Uses
a. No person who is a minor by age may use this App.
b. No person may use this App without acceptance of the terms and conditions, as a whole.
c. Subject to Registration
The use of SaveBox App is subject to registration via Email/Mobil Phone Number etc or whatever other method currently employed by us. Information provided during registration must be true and complete. All information entered during registration will be deemed to be correct and complete. Any liability arising out of missing, incomplete or incorrect information rests with the User. This clause is also applicable to the information provided during purchase of products on SaveBox App including Payment and Shipping Information.
d. Limitations on Use.
By using our Services, you agree on behalf of yourself, your users and your attendees, not to (i) modify, prepare derivative works of, or reverse engineer, our Services; (ii) knowingly or negligently use our Services in a way that abuses or disrupts our networks, user accounts, or the Services; (iii) transmit through the Services any harassing, indecent, obscene, fraudulent, or unlawful material; (iv) market, or resell the Services to any third party; (v) use the Services in violation of applicable laws, or regulations; (vi) use the Services to send unauthorized advertising, or spam; (vii) harvest, collect, or gather user data without their consent; or (viii) transmit through the Services any material that may infringe the intellectual property, privacy, or other rights of third parties.
e. Proprietary Rights and SaveBox App Marks.
You acknowledge that we or our licensors retain all proprietary right, title and interest in the Services, our name, logo or other marks (together, the “SaveBox App Marks”), and any related intellectual property rights, including, without limitation, all modifications, enhancements, derivative works, and upgrades thereto. You agree that you will not use or register any trademark, service mark, business name, domain name or social media account name or handle which incorporates in whole or in part the SaveBox App Marks or is similar to any of these. You agree to comply with our Branding Guidelines, available on enquiry.
2. BID CREDIT
SaveBox App uses a non-transferable token called BID CREDIT that is purchased by the user and used to enter bids from their registered account. BID CREDIT is a token to use the services provided by SaveBox App, i.e. to participate in or enter each bid, and may in no way be construed as a currency of any sorts or forms. Only Persons who have attained Majority by age are permitted to purchase the same. SaveBox App is the only seller of BID Credits and BID Credits acquired from any other source will be deemed to be fraudulent and subject to Suspension and Termination below.
Bid Credits once spent is non-redeemable and is treated as a token to avail the services offered by SaveBox App. SaveBox app may on a promotional basis offer discounts based on the number of Bid Credits spent by users who have not won the bidding process in a particular bid and wish to buy the product at the displayed price immediately after the bidding process ends. SaveBox app reserves the right to change or modify such promotional offer without any prior notice.
SaveBox App uses a unique mechanism of bidding or auctioning to sell the products providing an opportunity to customers to acquire the same at considerably lower prices.
· The products displayed on the application if available for bidding may be bid on by the customer.
· Each bid starts at a pre-determined time that is displayed on the bid/product page. Each bid is available for a limited time as displayed on the product/bid page. The bidding process will come to an end once such time elapses.
· The starting price of the bid is pre-determined and displayed on the product/bid page.
· Once such bid starts each user has the opportunity to make a bid towards the product and may do so in increments that are available based on our proprietary algorithm.
· Each bid uses a pre-determined amount of Bid Credits from the user's account as displayed on the product page.
· Users may only make bids if they possess the requisite number of Bid Credits. If Not, they will be redirected to the page for purchasing the same.
· Once a bid is placed a timer starts. This timer is auto-renewed with each bid by users. All bids occur live and ensure fair participation towards all prospective bidders. If no bid is entered the bidding process comes to an end when the timer reaches 0:00.
· The bidding process will also end once the pre-determined upper limit price is bid on by a user. This is to ensure that no product will be sold above its actual price.
· Once the bidding process comes to a close, the last bidder will be notified in the application as to have won the bid. They will now have the option open to buy the product the amount which they bid on. The time limit to make such purchase will be 2 days (48 hours). Failure to complete the payment within the prescribed time limit will be deemed to be a forfeit of the product bid on. In such event the person with the second highest bid will be deemed eligible and contacted by SaveBox to purchase the product at the price they bid at.
· Once the price is paid, and the shipping details are entered, the product will be dispatched by SaveBox app and will reach the customer within a span of 5-10 days unless effected by any unavoidable delays.
· It may be noted that customers may purchase the products at the displayed prices (Not the price at which bidding starts) without participating in the bidding process if they wish to do so.
. One person can only purchase Products only 1 a days #3 a week #10 a month
. One profile can win a product only a day. Once win a product a day, they are not permitted to participate in other bid events. The second win is not eligible.
. Once won the bid, the purchase & payment should do within the next 48 Hours.
. The “previous deals” page will be available only for the next 48Hours
4. Refund & Cancellation Policy
As of now, products are deliverable from SaveBox Application/website only within the state of Kerala. Due consideration may be given to the same before making a purchase or initiating the bidding process. In order to ensure the same, the shipping address pin code is locked to pin codes within the state of Kerala. SaveBox will not be liable for any products to be deliverable outside the state of Kerala.
The rights and liabilities of the Products displayed on SaveBox App rests with their respective Manufacturer/reseller and any claims or warranties arising out of the same must be made to the respective Manufacturer/reseller.
Replacement/Refund: In the event that a product shipped by SaveBox App is defective (as stated or covered by the warranty of each individual product) or damaged in transit, the customer must inform the same SaveBox App within a period of 24 hours of the delivery to be eligible for a replacement. One such report is received, an executive of the SaveBox app will contact the customer to verify the veracity of the claim. SaveBox app will initiate a replacement or refund if such a claim is found to be genuine.
If such report is not made within 24 hours of the delivery, the product will be deemed to be non-defective and not damaged.
Cancellation: SaveBox App does not entertain cancellations as the bidding process is unique and cancellations, once the bid is won, will disrupt the entire process. As such due diligence and consideration may be taken before placing a bid or purchasing bid credits. In the event that a customer repeatedly wins bids but fails to buy the product, such accounts may be suspended and/or terminated based on the clause of suspension and termination.
5. Shipping of Products
Products will be shipped only within the State of Kerala.
Shipping of products will be subject to the estimated delivery time displayed on the product page plus 3 days for any unforeseen delays.
6. Limitation on indirect liability.
Neither party will be liable to the other party or to any other person for any indirect, special, consequential or incidental loss, exemplary or other such damages, including, without limitation, damages arising out of or relating to: (i) loss of data, (ii) loss of income, (iii) loss of opportunity, (iv) lost profits, or (v) costs of recovery, however, caused and based on any theory of liability, including, but not limited to, breach of contract, tort (including negligence), or violation of statute, whether or not such party has been advised of the possibility of such damages. Some jurisdictions do not allow limitation or exclusion of liability for incidental or consequential damages, so some of the above limitations may not apply.
7. Fees and Payment.
You agree to pay all applicable, undisputed fees for the goods both digital and physical, on the terms set forth on the invoice. Any and all payments you make to us for access to the Services are final and non-refundable. You are responsible for all fees and charges imposed by your data transmission providers related to your access and use of the Services. You are responsible for providing accurate and current billing, contact and payment information to us or any reseller. You agree that we may take steps to verify whether your payment method is valid, charge your payment card or bill you for all amounts due for your use of the goods. You agree that your credit/debit card information and related personal data may be provided to third parties for payment processing and fraud prevention purposes. We may suspend or terminate your Services if at any time we determine that your payment information is inaccurate or not current, and you are responsible for fees and overdraft charges that we may incur when we charge your card for payment. We will not agree to submit invoices via any customer procure-to-pay online portal or Electronic Data Interchange (EDI) portals. We reserve the right to update the price for Services or goods at any. We will notify you of any price changes by publishing on our website, emailing, quoting, or invoicing you.
- Sales, Promotional Offers, Coupons and Pricing.
Sales, promotions, and other special discounted pricing offers are temporary, and, upon the renewal of your subscription, any such discounted pricing offers may expire. We reserve the right to discontinue or modify any coupons, credits, sales, and special promotional offers in our sole discretion.
- Disputes; Delinquent Accounts.
You must notify us of any fee dispute within 15 days of the invoice date, and once resolved, you agree to pay those fees within 15 days. We may, on notice to you, suspend or terminate your Services if you do not pay undisputed fees, and you agree to reimburse us for all reasonable costs and expenses incurred in collecting delinquent amounts.
You are responsible for all applicable GST, cesses or any other similar fees as may be applicable in the location in which the Services are being and similar taxes or fees (collectively, “Taxes and Cesses”) imposed by any government entity or collecting agency based on the Services, except those Taxes and Cesses based on our net income, or Taxes and Cesses for which you have provided an exemption certificate. Additionally, if you do not satisfy your Tax and Cesses obligations, you agree that you will be required to reimburse us for any Taxes and Cesses paid on your behalf, and we may take steps to collect Taxes and Cesses we have paid on your behalf. In all cases, you will pay the amounts due under this Agreement to us in full without any right of set-off or deduction.
12. Suspension and Termination
We may suspend your user account or temporarily disable access to whole or part of any Service in the event of any suspected illegal activity, extended periods of inactivity, or requests by law enforcement or other government agencies. Objections to suspension or disabling of user accounts should be made to email@example.com within thirty days of being notified about the suspension. We may terminate a suspended or disabled user account after thirty days. We will also terminate your user account on your request.
In addition, we reserve the right to terminate your user account and deny the Services upon reasonable belief that you have violated the Terms. Termination of user account will include denial of access to all Services, deletion of information in your user account such as your email address and password and deletion of all data in your user account.
